1. About Us and Scope

This Privacy Policy applies to the Website and to the products and services offered by Lana Nisnevich, Osek Patur, business address: Kfar Giladi 43, Tel Aviv, Israel ("we", "our", "us" or the "Company").

We offer the digital product "Treatment" (a personalized document on personal brand strategy and social media presence), individual mentoring sessions, and a free workbook provided upon subscription to our newsletter. Our products and services are marketed under the name "Social Media Терапевт" ("Social Media Therapist"); this is a marketing term and does not indicate medical or psychotherapeutic activity.

The Website consists of a home page and a product page for "Treatment". The Website links to our social media profiles (Instagram, LinkedIn, Telegram, TikTok, YouTube) and to our newsletter on the Substack platform.

This Privacy Policy is an integral part of our Terms and Conditions.

2. General Provisions

Information about you is collected when you use the Website and when you use our products and services.

Some of this information identifies you personally: for example, your name, email address, phone number, messenger handle, payment-related information, questionnaire answers and other details you provide when contacting us or making a purchase. This is information you knowingly provide to us.

Some information does not personally identify you. This is statistical and aggregate information, for example the pages you viewed on the Website, the language version you selected, and the offers that interested you.

Certain technical data and online identifiers may be considered Personal Information under applicable law, including IP address, device identifiers, advertising identifiers and identifiers stored in cookies and similar technologies.

This Policy is intended to comply with applicable Israeli privacy and data protection laws, including the Protection of Privacy Law, 5741-1981 (including Amendment No. 13), and the Protection of Privacy Regulations (Data Security), 5777-2017, as may be amended from time to time. Where we transfer Personal Information outside Israel, we do so in accordance with the Protection of Privacy Regulations (Transfer of Data to Databases Outside the State Borders), 5761-2001, and any other applicable requirements.

We may collect the following categories of information.

Contact details. First name, last name, email address, phone number, Telegram or other messenger handle – when you contact us or place an order.

"Treatment" questionnaire data. The answers you give in the questionnaire: information about you, your activity, goals, audience, social media experience and other context required to prepare the personalized document. You decide how much information to share; we ask that you do not include special-category data (for example, health information) unless it is necessary for the work.

Information about your social media accounts. The profile links you provide to us and the publicly available information in those profiles that we review when preparing the Treatment: posts, profile presentation, public metrics. If you voluntarily provide us with screenshots or exports of your accounts' internal analytics, we process them for the same purpose.

Information shared during sessions and calls. The subject matter of the discussion, your goals and the notes we take in order to deliver the service.

Payment-related information. The fact and amount of payment, date, transaction status, order identifier, and the data required to issue invoices and comply with tax reporting obligations. We do not receive or store full payment card details: payments are processed by a third-party payment provider operating under its own terms and privacy policy.

Technical data. IP address, device and browser type, operating system, language preferences, referral source, pages visited and time spent on them.

Cookie and similar technology data. See Section 7.

4. How We Use the Information

We use the information collected in accordance with this Privacy Policy and applicable law, in order to:

  • provide our services and products to you, including preparing the personalized "Treatment" document and conducting mentoring sessions;
  • communicate with you about your order: scheduling, reminders, delivery of materials, follow-up;
  • process payments, issue invoices and provide documents required under tax law;
  • respond to your inquiries and provide customer support;
  • improve our Website, products, services and content;
  • analyze use of the Website and produce statistics;
  • modify, discontinue or introduce new products and services;
  • send you marketing and informational communications about our products and services, where permitted by law and subject to your right to opt out at any time;
  • measure the effectiveness of our advertising campaigns;
  • comply with our legal obligations and protect our legal rights.

5. Legal Bases for Processing

We process Personal Information on the basis of your consent (given when you provide us with data or select the relevant options), as well as to the extent necessary to perform our contract with you, to comply with our legal obligations (including tax obligations), and to protect our legitimate interests.

Consent may be withdrawn at any time; withdrawal does not affect the lawfulness of processing carried out prior to the withdrawal and does not override retention obligations imposed on us by law.

6. Sharing Information with Third Parties

We will not pass on to third parties your personal details or information collected about your activity on the Website, except in the following cases.

Service providers that help us operate our business – strictly for the purposes of providing services to us and subject to confidentiality obligations. In particular:

  • website hosting and maintenance;
  • the third-party payment provider that processes payments;
  • the Substack platform (newsletter and workbook delivery);
  • email services and messaging apps through which we correspond with you;
  • video-call services used to hold sessions and calls;
  • scheduling tools and calendars, where used;
  • analytics and advertising services (Google Analytics, Meta Pixel);
  • accounting and invoicing support, as required by law.

In addition, information may be disclosed:

  • in the event of a legal dispute between you and the Company that requires the disclosure of your details;
  • if your actions on the Website are against the law;
  • if a court ruling or other legally binding order requires us to provide your details or information about you to a third party;
  • if the Company sells or transfers the Website operation to any corporation in any way, or in the event that it merges with another entity or merges the Website operation with the activities of a third party, provided that such corporation accepts the provisions of this Privacy Policy towards you;
  • with your explicit consent.

We do not sell your Personal Information.

7. Cookies, Pixels and Analytics

We use cookies and similar technologies (pixels, tags, local storage) on the Website to enable core functionality, provide security, enhance user experience, analyze performance and support marketing activities.

Cookie Categories

  • Essentials (Strictly Necessary). Required for the Website to function and for security and fraud prevention. These cookies are always active.
  • Preferences / Personalization. Used to remember your choices, for example the selected language.
  • Analytics. Used to understand how the Website is used and to improve it. We use Google Analytics.
  • Marketing. Used to measure and optimize marketing campaigns and deliver advertising. We use the Meta Pixel (Meta Platforms), which allows us to measure the effectiveness of advertising on Facebook and Instagram and to serve ads to users who visited the Website.

Essentials Examples (Always Active)

Security cookies and tokens used to detect fraud, abuse or automated traffic; cookies required to enable and secure form submissions and protect them from bots (including CAPTCHA / reCAPTCHA-related cookies where applicable); session and load-balancing cookies used to maintain stability and performance; cookies used to store your cookie-consent status and preferences; and cookies required to provide a feature you explicitly requested.

Except for Essentials, we place and use cookies only after you provide your consent via the cookie consent banner on the Website. You can consent to all categories or choose specific categories. You can withdraw or change your consent at any time via the cookie settings link on the Website.

We may retain a record of your cookie preferences (including the date/time and categories chosen) to demonstrate compliance and to respect your choices.

Impact of Refusal

If you reject non-essential cookies (or certain categories), some parts of the Website may not function as intended – for example, your preferences may not be remembered or certain embedded content may not display.

8. Substack Newsletter and Free Workbook

Subscription to our newsletter and delivery of the free workbook are handled through the Substack platform. When you subscribe, your email address and related data are collected and processed directly by Substack as an independent service provider, in accordance with its terms and privacy policy. Substack stores data on servers located outside Israel, including in the United States.

We have access to the subscriber list and newsletter statistics (for example, email opens and link clicks) through the Substack interface, and we use this data to send you emails and to understand which content is of interest to you.

You may unsubscribe at any time via the link in the email or in your subscription settings.

9. Social Media

Links on the Website lead to our profiles on Instagram, LinkedIn, Telegram, TikTok, YouTube and Substack. By following them, you access third-party platforms that collect data about you for their own purposes and under their own rules. We do not control these platforms and are not responsible for their data processing.

If you interact with us within social networks (comments, direct messages), the processing of such communications is also governed by the rules of the relevant platform.

When preparing a Treatment, we review the publicly available information in the accounts whose links you provided to us. We do not request or use passwords to your accounts.

10. International Transfers

Some of our service providers (including newsletter, analytics, advertising, hosting, video-call and payment providers) are located outside Israel, including in the United States and the European Union. This means your Personal Information may be transferred to and processed outside Israel. We carry out such transfers in accordance with the Protection of Privacy Regulations (Transfer of Data to Databases Outside the State Borders), 5761-2001, and other applicable requirements, including on the basis of your consent and the providers' contractual data protection obligations.

11. Data Security

We implement up-to-date information security systems and procedures and act in accordance with applicable requirements under Israeli law, including the Protection of Privacy Regulations (Data Security), 5777-2017. While these systems and procedures reduce the risks of unauthorized intrusion, they do not provide complete security. Therefore, we do not warrant that our systems will be completely immune from unauthorized access to the information stored therein.

12. Your Rights

Under the Protection of Privacy Law, 5741-1981 (including Amendment No. 13), and other applicable law, you may be entitled to request access to Personal Information we hold about you, and to request that such information be corrected, updated or deleted (as applicable).

Where we use your Personal Information for direct marketing, you may be entitled to object and/or request deletion of such information from our databases, in accordance with applicable law. We may request additional information from you to verify your identity before fulfilling a request.

13. Retention

We retain Personal Information for as long as necessary to provide our services to you, to comply with our legal, tax and accounting obligations, and to resolve disputes and enforce our agreements.

In particular:

  • documents relating to payments and tax reporting are retained for the periods prescribed by Israeli law;
  • correspondence and order-related materials are retained for a reasonable period after completion of the work, so that we can respond to your questions and evidence delivery of the service;
  • newsletter subscriber data is retained until you unsubscribe or withdraw consent.

When Personal Information is no longer required, it will be deleted or anonymized.

14. Children

Our Website, products and services are intended for individuals aged 18 and over. We do not knowingly collect Personal Information from individuals under the age of 18. If you become aware that a person under 18 has provided us with Personal Information, please contact us so that we can delete such information.

15. Changes to this Privacy Policy
